Terms and Conditions

 

These terms and conditions ("Terms") govern the use of tutoring services provided by Mr Porter Tutoring ("the Company") to the clients ("Clients" or "You") in the United Kingdom. By engaging in our tutoring services, you agree to be bound by these Terms. Please read them carefully.

 

1. Tutoring Services

   a. The Company provides tutoring services in various subjects and academic levels.

   b. The Company will assign a qualified tutor ("Tutor") based on the specific requirements of the Client.

   c. Tutoring sessions will be conducted at mutually agreed-upon locations or online platforms.

   d. The frequency, duration, and timing of tutoring sessions will be determined by mutual agreement between the Client and the Tutor.

 

2. Payment

2.1 For Private Clients (Parents and Guardians)

 a. All fees for tutoring services are payable monthly in advance, prior to the first session of each month.
b. Payment methods accepted include bank transfer and any other methods agreed in writing.
c. Invoices will be issued at least 7 days before the payment due date.
d. If payment is not received within 7 days of the due date, the Company reserves the right to:

  • Apply a late payment fee of £10 per overdue payment to cover administrative costs.

  • Suspend further tutoring sessions until the account is brought up to date.
    e. We understand that unforeseen circumstances may arise. Please contact us promptly if you anticipate difficulty in meeting a payment deadline so that we can discuss alternative arrangements.

2.2 For Commercial Clients (Schools, Businesses, and Organisations)

 a. Payment terms for commercial clients are strictly 30 days from the date of invoice, unless otherwise agreed in writing.
b. Invoices not paid by the due date may incur:

  • Statutory interest at a rate of 8% per annum above the Bank of England base rate, calculated daily.

  • A fixed late payment fee of £40 (for debts under £1,000), £70 (for debts between £1,000–£10,000), or £100 (for debts over £10,000), as permitted under the Late Payment of Commercial Debts (Interest) Act 1998.

  • Recovery of reasonable costs incurred in pursuing overdue amounts, including legal fees and collection agency charges.

 c. The Company reserves the right to suspend services or withhold delivery of further sessions until outstanding invoices are paid in full.

 

3. Cancellations and Rescheduling

   a. Clients must provide at least 24 hours' notice for session cancellations or rescheduling requests.

   b. Failure to provide the required notice may result in the Client being charged for the missed session.

   c. In case of unforeseen circumstances, the Tutor or the Company may need to cancel or reschedule sessions. Reasonable efforts will be made to notify the Client promptly and arrange an alternative session.

 

4. Confidentiality and Privacy

   a. The Company and the Tutor will respect the privacy and confidentiality of the Client and their personal information.

   b. Any personal information provided by the Client will be handled in accordance with applicable data protection laws and the Company's privacy policy.

 

5. Code of Conduct

   a. Clients are expected to treat Tutors with respect and courtesy.

   b. Any form of harassment, discrimination, or inappropriate behavior towards the Tutor or other Clients will not be tolerated.

   c. Clients shall not share, reproduce, or distribute any tutoring materials provided by the Company or Tutor without obtaining prior written consent.

 

6. Limitation of Liability

   a. The Company and its Tutors shall not be held liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use of tutoring services or reliance on any information or advice provided.

   b. The Company and its Tutors shall not be responsible for the academic performance or outcomes of the Client.

 

7. Termination

   a. Either party may terminate the tutoring services by providing written notice to the other party.

   b. Upon termination, any outstanding fees must be settled, and any prepaid fees for unused sessions may be refunded as per the Company's refund policy.

 

8. Amendments

   a. The Company reserves the right to modify or update these Terms from time to time. Clients will be notified of any changes, and continued use of the tutoring services will indicate acceptance of the modified Terms.

 

9. Governing Law and Jurisdiction

   a. These Terms shall be governed by and construed in accordance with the laws of the United Kingdom.

   b. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.

 

By engaging in our tutoring services, you acknowledge that you have read, understood, and agreed to abide by these Terms and Conditions.
